In addition to implementing it in its organizational processes, ACH BRITO S.A. has a Privacy Policy, which you can view here, with the aim of providing, making available and publicizing an explanatory document outlining the general rules regarding privacy and the processing of personal data it collects in the context of its activities.

Given the specific context of this website's use, ACH BRITO has established a specific policy for users of the clausporto.com website and its online store, which transparently explains how personal data is processed.

II. Processing of Personal Data

a) Data Controller:
ACH BRITO S.A. is the entity responsible for defining the means and purposes of personal data processing.

b) Purpose and Lawfulness of Processing:
Personal data is collected and processed during the use of the website for the general purposes of managing the purchase and sale relationship, fulfilling the obligations arising therefrom—including tax obligations—and carrying out marketing campaigns whenever consent has been given, or based on the legitimate interest of the data controller. When processing is based on our legitimate interest, we first weigh the interests of ACH BRITO against the rights, freedoms, and reasonable expectations of the data subjects. The data subject may object, at any time, to the processing of their data based on legitimate interest, in accordance with applicable terms.

Browsing the website may involve the collection and processing of electronic identifiers to optimize the user experience and facilitate website management. This data processing is based on the user's consent, when necessary, and on our legitimate interest in monitoring and improving the website's performance.

c) Categories of Personal Data Collected:
For the aforementioned purpose, the following data may be processed: identification data, billing data, contact data, and electronic identifiers.

d) Browsing Data and Cookies:
The clausporto.com website includes a set of features whose operation requires the collection of data typically referred to as browsing data, as this data results from the website user's direct actions. Part of this data is collected through the cookies in use. We have implemented a cookie management solution that gives users full control over their consent preferences regarding the use of this type of technology. For more information, please refer to the Cookie Policy here.

e) User Account Creation:
ClausPorto operates an online store that allows registered users to access it by providing identification and contact information. This information allows you to manage services related to the purchase and sale transaction, such as viewing invoices and other transaction history. If you wish to delete your registration as a user of our online store, please send a request to dpo@achbrito.com so that we can cancel your registration and immediately delete all data associated with it. This deletion process does not apply to the history of completed transactions, which we are required to retain in accordance with legal obligations imposed by tax legislation.

f) Payments via Klarna:
The online store offers payment through the Klarna platform. This payment method involves the processing of personal data by the entity that supports it, which acts as the Data Controller. We ask that you review the terms and conditions, including those regarding the processing of personal data, as implemented by that entity. This information can be accessed via this link.

g) Direct Marketing:
We may also engage in direct marketing activities based on our legitimate interest, following the establishment of a pre-existing relationship. We will only do so when we believe that this does not affect your rights and freedoms, and in that specific context, we do not require your consent. Whenever this occurs, we will clearly inform you of the basis for such processing and how you may exercise your right to object to receiving future communications.

h) Newsletter Subscription:
Clausporto offers a newsletter service through which it shares detailed information about the brand and its products. To use this service, the user must provide a valid email address. At any time, users are free to unsubscribe by emailing dpo@achbrito.com or by clicking the unsubscribe link in any email they receive, if they so wish. This service aims to keep interested parties informed about Clausporto's news and offers, promoting continuous and effective communication with its customers and followers.

i) Retention Period for Personal Data:
The personal data collected is retained for as long as business relationships with our customers exist, for as long as valid consent is in effect (when consent is a necessary condition for lawfulness), and, additionally, for the period required by law, specifically to comply with tax obligations.

j) Recipients or Categories of Recipients of Personal Data:
The personal data collected will not be shared with third parties, except for entities to whom the data must be disclosed pursuant to a legal or legitimate provision, or at the Customer's request. If it is necessary to use services provided by processors, such processing will be governed by contract, requiring them to comply with the obligations we deem necessary.

k) Processing of Personal Data by Processors:
Personal data may be processed by service providers contracted by ACH BRITO, acting as processors, specifically in the areas of website hosting and maintenance, technology platforms, order management, shipping, payments, billing, accounting, customer support, marketing, and statistical analysis. These service providers process personal data only in accordance with ACH BRITO's documented instructions and under a contract that imposes obligations regarding confidentiality, security, and data protection.

l) International Transfers:
Whenever personal data is transferred to third countries outside the European Economic Area, ACH BRITO will ensure that such transfer occurs in accordance with Articles 44 et seq. of the GDPR, specifically based on adequacy decisions, standard contractual clauses, or other legally established mechanisms.

m) Rights Regarding Collected Personal Data:
The Customer has the right to exercise their rights of access, rectification, portability, restriction of processing, withdrawal of previously given consent, objection, or erasure of their personal data by contacting us in writing via email at dpo@achbrito.com or by mail to the postal address located at Rua Castelões Sul, 346, 4485-103 Fajozes.
