The present conditions are agreed by the brand Claus Porto, by the company Ach Brito & CA. S.A., by those who wish to buy products using the www.clausporto.com website, further along designated "customers". For USA customers, purchasing via www.clausporto.com/us, on our USA website, these conditions are agreed by the company ACH. BRITO INC. You may only purchase products from our site if you are at least 18 years old and if you are legally capable of entering into binding contracts. These conditions aim to define the terms of sale between Claus Porto and its customers, from payment methods to shipment of the purchased products. These conditions regulate all the necessary stages of order placement and guarantee the necessary follow-up. We may update or amend these Terms from time to time. We may need to revise or amend these Terms to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements, and changes in our system's capabilities. Please review these Terms regularly to ensure you are aware of any of the changes we have made. Your continued use of our Site after changes are posted means you agree to be legally bound by these terms as updated/amended. Once your order has been confirmed we will not make any changes to the Terms that apply to your order.

We do not guarantee that all the items available at the clausporto.com online shop are in stock at the time of your order, nevertheless, we concentrate our efforts so everything is the most accurate as possible. CLAUS PORTO cannot guarantee that the content of clausporto.com is at all time free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. CLAUS PORTO may at any time change the content of the site and the items available in the product range. CLAUS PORTO cannot be held responsible for any damage caused from using the site or not being able to use the site.
The images of the products on our site are for illustrative purposes only. The products and its packaging may vary slightly from those images even though we have been careful with every detail so they can look as real as possible.

Ordering

The customer may register in the website (www.clausporto.com) in order to place an order using the online shop. If you register on CLAUS PORTO you are able to check the status of your order. If you wish not to register to place your order, you may do so, nevertheless you won’t be able to check its status on our site but you will receive the tracking number of shipment as well. By placing an order the customer accepts the prices and descriptions available for sale.

Product loss

In the eventuality of the order not arriving within the deadline indicated by the carrier company, the customer will be asked to provide all necessary documentation as (in order) to make a complaint. Claus Porto is required to wait for the conclusion of the inquiry made by the carrier company before reshipping or reimbursing the purchase in cause. The time this process takes is of the responsibility of the carrier company, not Claus Porto’s.

Payment

The payment is made by credit card only. All confidential data will be used strictly and only to proceed to the payment of the placed order. Claus Porto will not use the data its customers provide beyond the authorization given by the customers. Claus Porto will not store customers’ confidential data and will not take responsibility for any wrongful use of the customers’ private data that is made from within the Claus Porto company. ADYEN is the company responsible for all payments and connections with the bank. If and when fraud is suspected several tests will be made by ADYEN, having always in mind the security of our clients.

Payment security

When paying orders using credit cards, customers are asked to provide their credit cards number and expiring dates. The authorization servers of the banking entity will be accessed in order to verify the provided data, to prevent and avoid frauds and other abuses. For security purposes, the server is encrypted and all provided data is coded. None of the provided data will be available on the internet. All payments are processed by ADYEN, that has PCI compliance, thus Claus Porto doesn’t keep any of your payment data.

Returns

We believe you will love our products as much as we do, but if you are unhappy with your purchase and would like to return or exchange part or all of your order then please contact us to support@clausporto.com and we will gladly help you.
Simply email support@clausporto.com and include your order number, reason for the return and pictures of the product. Please also include your name, e-mail address and phone number so that we can contact you, if necessary. In addition we suggest you take and send us pictures of the product and the pack where the return is made. Package your return item in CLAUS PORTO packaging or in a well-padded envelope or box to prevent damage in transit. In case the product is damaged no reimbursement will be made.
You will receive an email confirmation once return is processed.
You can return purchased items within 14 days after the sale, if the items are returned in their original package and in the same conditions in which they were sold. The cost of the items will be refunded, but shipping costs are of the entire responsibility of the customer. If you are returning your order due to quality problems the shipping cost will be refunded as well.
If you chose to return any products to us, we will not be responsible for loss or damage to them in transit. We therefore recommend that Products are returned to us using a reputable recorded delivery service. If Products are damaged or lost in delivery we reserve the right to charge you, or not to refund any amounts due to you, that are attributable to the loss or damage.
We will refund to you using the same method originally used by you to pay us for your purchase.

Pricing

The prices are presented in Euros (€), with the applicable taxes already added. The VAT is placed at 23%. For the USA the prices are presented in US Dollars ($). In this case, taxes might be applied at checkout, depending on location. The price list presented on the website (www.clausporto.com) is subject to constant checking, but errors may occur. The price list can be modified without previous warning.

For Outlet Days products no refunds are allowed in case of price drops.
